(dc) Diligent Creators
These Terms of Service (“Terms”) govern your use of the iBiz platform, a managed invoicing service provided by Diligent Creators (“we,” “our,” “us”). By accessing or using iBiz, you (“you,” “your,” “Client,” or “User”) agree to be bound by these Terms.
Service Description
- iBiz provides a SaaS-based invoicing solution that connects to the Federal Board of Revenue (FBR) through PRAL (Pakistan Revenue Automation Ltd.), an official FBR-licensed integrator.
- We are not an official FBR Licensed Integrator. Instead, we facilitate the technical connection between your business and PRAL’s system.
- Each Client is provided a unique subdomain (e.g., company.ibiz.com.pk) and login credentials for their account.
Client Responsibilities
- You remain legally responsible for the accuracy, completeness, and timely submission of all invoices to FBR.
- You must keep your login credentials secure and confidential.
- Any misuse, unauthorized access, or illegal activity under your account is your responsibility.
- You agree not to use iBiz for fraudulent, unlawful, or non-compliant invoicing.
Data Privacy & Security
- We implement encryption, backups, and strict security measures to safeguard your data.
- Despite best efforts, we cannot guarantee uninterrupted availability or protection against third-party attacks, FBR outages, or PRAL downtime.
- We do not sell or share your data with unauthorized third parties.
Service Availability
- iBiz depends on PRAL and FBR systems. Service interruptions, downtime, or errors on their side are outside our control.
- We strive to ensure uptime and recovery through backups and failover systems but provide no guarantee of 100% availability.
Fees & Payments
- Pricing and payment terms are communicated separately at the time of onboarding.
- Non-payment may result in suspension or termination of your account.
- All fees are non-refundable unless otherwise stated in writing.
Limitation of Liability
- We provide iBiz “as is” and “as available.”
- We are not liable for:
- Errors or penalties arising from incorrect taxpayer data,
- FBR system downtime, PRAL integration issues, or regulatory changes,
- Any indirect, incidental, or consequential damages.
- Our maximum liability shall not exceed the fees paid by you in the last 3 months of service.
Account Suspension & Termination
- We may suspend or terminate accounts if:
- Fees remain unpaid,
- The service is misused,
- There is a legal requirement or FBR/PRAL directive.
- Clients may terminate the service by providing written notice.
Intellectual Property
- iBiz, its software, and related materials are owned by Diligent Creators.
- You are granted a limited, non-exclusive, non-transferable right to use the platform solely for invoicing purposes.
Changes to Terms
- We may update these Terms periodically. Updates will be posted on our official website.
- Continued use of iBiz after changes means you accept the updated Terms.
Governing Law
- These Terms are governed by the laws of Pakistan.
- Any disputes shall be resolved in the courts of Karachi, Pakistan.
